Custody is determined according to the best interests of the child. Courts may consider the child’s relationship with each parent, stability, caregiving history, parental fitness and other circumstances affecting the child.

No. Georgia uses equitable distribution, meaning marital assets are divided fairly based on the circumstances—not necessarily in equal halves. Separate property must first be distinguished from marital property.

An unmarried father generally must complete the legitimation process before Georgia courts can grant legal custody or visitation rights. Being listed on the birth certificate or paying support may not be enough by itself.
